RELEASE AND WAIVER OF LIABILITY OWEN
COUNTY PACE

The undersigned represents that he or she is fully aware
that the activities of the Camargo Hunt, Inc., including but not limited to the
The undersigned, on behalf of themselves and their
representatives, heirs and assigns, hereby release, waive, discharge, and agree
not to sue Camargo Hunt, Inc., its Joint Masters, officers, directors,
huntsmen, whippers-in, agents, representatives, members, and employees in their
capacities as such and the owners and lessees of the land where injuries to the
undersigned or the undersigned’s horse may have occurred (Released Parties) and
agrees to indemnify, including payment of attorney’s fees and costs, and hold
each of the Release Parties harmless with respect to any losses or damages,
injuries or death to the undersigned and the horse utilized by the undersigned,
whether caused by negligent or reckless acts of such Released Parties or
otherwise.
The undersigned, on behalf of themselves and their
representatives, heirs and assigns, hereby release, waive, discharge, and agree
not to sue Camargo Hunt, Inc., its Joint Masters, officers, directors,
huntsmen, whippers-in, agents, representatives, members, and employees in their
capacities as such and the owners and lessees of the land where injuries to the
undersigned or the undersigned’s horse may have occurred (Released Parties) and
agrees to indemnify, including payment of attorney’s fees and costs, and hold
each of the Release Parties harmless with respect to any losses or damages,
injuries or death to the undersigned and the horse utilized by the undersigned,
whether caused by negligent or reckless acts of such Released Parties or
otherwise.
This release specifically covers, but is not limited to
inherent risks of an equine activity which means a danger or condition that is
an integral part of equine activity including, but not limited to any of the
following:
- The propensity
of an equine to behave in ways that may result in injury, death or loss to
persons on or around the equine;
- The
unpredictability of an equine’s reaction to sounds, sudden movement, unfamiliar
objects, persons, or other animals;
- Hazards,
including but not limited to surface or subsurface conditions;
- Collision with
another equine, another animal, a person, or an object;
- The potential
of an equine activity participant to act in a negligent manner that may
contribute to injury, death or loss to the person or participant or to other persons, including but not
limited to, failing to maintain control over an equine or failing to act within
the ability of the participant.
The foregoing release is given for the purpose, among other
things, of providing a waiver under Section 2305.321© of the Ohio Revised Code.
The term “equine activity” is defined in Section 2305.321 to include, among
other things, the activities with the Camargo Hunt, Inc., including but not
limited to, the Camargo Hunter Trials, Point to Point, and the Owen County Pace
Event.
I have read, understand and agree to be bound by this
Release and Waiver of Liability. If the person identified below is a minor,
this Release and Waiver of Liability is also executed by a parent or guardian
of the minor who, through such execution, also agrees to release and indemnify
the Released Parties, to the full extent provided above for themselves and for
and on the behalf of the minor and their representatives, additional relatives,
heirs, and assigns.

understand and agree to all provisions.
